Mr. Sabey is a shareholder at Fabian Van Cott, which he joined in 1997. Scott’s main area of practice is real estate development and related litigation, and he has been involved in real estate developments and transactions since 1985. He serves on the Board of Directors for the Utah Chapter of CCIM, and chairs its Forms Committee. Scott served on the Sandy City Planning Commission for more than a decade which he chaired, and he previously served on the Sandy City Board of Adjustment. Mr. Sabey has authored numerous real estate related articles, and is the recipient of the Distinguished Real Property Practitioner of the Year Award, from the Real Property Section of the Utah State Bar. He is also the Past-Chair of both the Real Property and Business Law Sections of the Utah State Bar, and was a member of the Board of Bar Commissioner for the Utah State Bar from 2004 to 2010. Mr. Sabey first became a Bar Examiner for the Utah State Bar Exam in the area of real property in 2001, and continues to serve today. Mr. Sabey served on the Utah Supreme Court’s Judicial Council for three years. Scott also served on the Utah Supreme Court’s Rules of Civil Procedure Sub-Committee for the promulgation of rules for Small Claims Court and participated in the Administrative Office of the Courts’ committee for the statewide reorganization of the Judge Pro Tempore system. Scott authored the original Small Claims Judge’s Bench Book, and has taught the Small Claims Judges and Justice Court’s Judges School since 2000. For more than 20 years Scott has been a Judge Pro Tempore.

Scott currently represents business interests from around the United States, as well as Canada, England, and Italy. He has been asked to serve as mediator in litigated disputes, and has repeatedly served as an expert witness for other attorneys in litigation. Scott’s real estate experience includes legal services on such developments as: golf courses; shopping malls; hotels; office buildings; hospitals; resort condominiums; municipal water companies; and, large scale residential developments. He has helped in financing on all kinds and sizes of projects from representing national banks in funding large-scale residential developments, to tax incremental financing, Federal HUD-242 hospital loans, and mortgage backed securities. He has represented many title companies (local, national and underwriters), real estate companies, and lenders in both litigation and administrative matters. Scott’s real estate litigation experience runs from small, neighborhood property line disputes to defending against damage claims in excess of 1.4 billion dollars. Mr. Sabey has also been a registered lobbyist for the last two decades, and has lobbied on behalf of the Bar and the Courts, as well as for a number of local and national companies and associations.

Since 2005 Mr. Sabey has held an “AV”, Pre-eminent, 5.0 out of 5.0 Peer Review Rating in Martindale Hubbell, which is the highest rating awarded to attorneys for professional competence and ethics. His peers around the State of Utah have consistently voted him as one of Utah’s “Legal Elite” in Utah Business Magazine since 2005. Nationally Mr. Sabey has been named one of the Best Lawyers in America every year since 2006, as well as in Super Lawyers, AVVO and is similarly listed in other services.
