Bio

Wayne M. Willoughby is a highly experienced medical malpractice attorney and respected member of the legal community who has earned with the highest rating (“AV-Preeminent”) offered by Martindale-Hubbell™ for professional competence and ethics based on confidential survey of bar members and the judiciary (1996—).

A 2009 recipient of the Maryland Daily Record’s “Leadership in Law Award”, and recognized eight years straight as among the “Top Lawyers in Maryland” by “Super Lawyer” Magazine, he has also achieved a superior rating of 10 by Avvo.

Partnered with two medical doctors who became lawyers, over his 26 years of practice representing the victims of medical mistakes, Mr. Willoughby and his associates have obtained numerous multi-million dollar recoveries for their clients in Maryland and across the United States.   His firm, Gershon, Willoughby & Getz, LLC, has a particular focus representing children who have suffered cerebral palsy and other birth injuries.

Through his appellate advocacy, Mr. Willoughby has helped protect and expand the rights of the injured.  These include cases establishing: The right of pregnant women to hold their obstetricians accountable for failing to convey abnormal fetal screening test results, thereby depriving women of their right to decide whether to continue with the pregnancy; The right of medical malpractice victims in the District of Columbia to hold negligent physician employees of the District of Columbia responsible for their negligence even when the deadline had expired for suing their employer; and, The right of brain damaged infants to receive compensation for future life-care expenses even when their parents’ claim for those expenses is barred by the statute of limitations.

In addition to his aggressive advocacy for his clients, Mr. Willoughby is active in the legal community both nationally and in Maryland.  Nationally, Mr. Willoughby serves as a Governor of the American Association for Justice (AAJ) — the national advocacy organization for lawyers who represent people injured by negligence).  He is also a past member of the AAJ Executive Committee and past Chair of the AAJ Council of State Delegates.   Furthermore, he is a member of several AAJ committees and the organization’s Birth Trauma Litigation Group.

In Maryland, Mr. Willoughby is chairperson of the Maryland Association for Justice Political Action Committee, which works to elect politicians who support the right of injured people to obtain justice in our courts.   In addition, he serves on the Maryland State Bar Association’s Committee on Ethics, along with numerous other state and county bar committees, and is a former President of the Maryland Association for Justice.  Recently, Mr. Willoughby was unanimously elected to serve as President-Elect of the James C. Cawood American Inns of Court, based in the Maryland State capital of Annapolis.
